This is a petition for grant of anticipatory bail for offence under Sections 304B and 34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.
The victim daughter of the informant was married with co-accused, Biteshar Paswan on 25.05.2015. There is allegation that the husband and other in-laws, including the petitioner, were demanding dowry and torturing for the same as a result whereof the victim died of strangulation on 05.01.2016. Submission of the petitioner is that husband is already in custody. The mother-in-law has already been allowed anticipatory bail in Cr. Misc. No. 30214 of 2016 by a coordinate Bench of this Court and allegation against the petitioner is similar to the mother-in-law.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with
Patna High Court Cr.Misc. No.48511 of 2016 (2) dt.13-12-2016 Ranitalab P.S. Case No. 4 of 2016 to the satisfaction of Sri Ranjeet Prasad, Judicial Magistrate, Danapur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
