JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-12-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Parsa Bazar P.S. Case No. 250 of 2018, disclosing offence under Sections 341, 323, 307, 354(B), 441, 427, 504, 379, 147, 148 and 149 of the Indian Penal Code.

Supplementary affidavit has been filed on behalf of the petitioner. Learned counsel for the petitioner submits that because of some misconception, the FIR was got registered making allegations constituting offence punishable under various sections of the Indian Penal Code. The parties have resolved their dispute. He also submits that in any case, there is no chance of the petitioner fleeing from the course of

Patna High Court Cr.Misc. No.74284 of 2018(2) dt.21-12-2018 2/2 investigation and trial, if granted anticipatory bail. Considering the above submission, this application is allowed. The petitioner, above named, in the event of his arrest or surrender before the Court within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learnedJudicial Magistrate, 1st Class, Patna in connection with Parsa Bazar P.S. Case No. 250 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
