2. The petitioner seeks regular bail in connection with Excise P.S. Case No. 730 of 2025 for the offence registered under Sections 30 (a) and 32(3) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, there is recovery of 162 litres of foreign liquor from the Innova Car bearing Registration No. JH1OK-6600. Petitioner is the driver of the seized car.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case being the driver of the seized car. He has no concern with the seized liquor. Nothing incriminating was recovered from the
Patna High Court CR. MISC. No.56837 of 2025(3) dt.17-09-2025 2/3 conscious possession of the petitioner. He has no knowledge about the seized liquor kept in the car as he was driving the said car on the instruction of the owner of the vehicle. Petitioner has no criminal antecedent. Petitioner undertakes to co-operate in the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court concerned, Gaya, in connection with Excise P.S. Case No. 730 of 2025, subject to the following conditions:-
(1) The petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself.
(2) Petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation
