2. The petitioner apprehends arrest in connection with Special Case No. 8760 of 2022 (arising out of Digha P.S. Case No. 863 of 2022) dated 15.12.2022 instituted for offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
3. As per the prosecution case, there is recovery of 30 liters of country-made liquor from co-accused Aman Kumar and Dhiraj Kumar, who were driving the motorcycle.
4. Learned counsel for the petitioner submits that she has been made accused only on the ground that she is the owner of the seized motorcycle. Learned counsel for the petitioner further submits that the motorcycle of the petitioner was
Patna High Court CR. MISC. No.56872 of 2023(2) dt.30-08-2023 2/2 borrowed by the co-accused for going to doctor clinic and she has no concern with the seized liquor. Petitioner is the house wife having no criminal antecedent.
5. Learned APP opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner above named be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Patna in connection with Special Case No. 8760 of 2022 (arising out of Digha P.S. Case No. 863 of 2022), subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) Anand Kr.
