Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 109, 406, 420, 494, 498A of the Indian Penal Code.
The basic accusation is of torture and performing second marriage.
It is submitted by learned counsel for the petitioner that marriage between the petitioner and the daughter of the informant has been declared null and void vide judgment dated 15.12.2011 passed by learned Principal Judge, Patna in Matrimonial Case No. 260 of 2011 whereas the present case was filed in the year 2012.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender
Patna High Court Cr.Misc. No.20498 of 2015 (3) dt.05-05-2015 2/2 before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran in connection with Raxaul P.S. Case No. 121 of 2012, arising out of Complaint Case No. 184 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
