The petitionera EW apprehending their arrest in connection with Barsoi P.S.Case nO.227 of 2018 registered for offences punishable under Sections 147, 341, 323, 448, 427, 307, 380 and 504 of the Indian Penal Code.

Allegation against the petitioner no.1 is that he caught hold the informant and the petitioner no.2 assaulted by Farsa on head causing grievous injury to him.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and so far petitioner no.1 is concerned, there is only allegation that he caught hold the informant.

Patna High Court Cr.Misc. No.78062 of 2018(2) dt.07-01-2019 2/2 Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that the petitioner no.2 has assaulted by Farsa causing grievous injury and the petitioner no.1 has caught hold the informant In view of the facts and circumstances, let the petitioner no.1 (Md. Hazrul), be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Katihar in connection with Barsoi P.S.Case no.227 of 2018. So Far petitioner no.2 (S.K. Muddin) @ Shekh Muddain @ Md. Sekh Muddin) is concerned, he is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

Accordingly this application with the above direction is disposed of.
