JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in Tajpur (Waini O.P.) P.S. Case No.351 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 16.44 litres of illicit liquor is said to have recovered from the fodder house of the petitioner and the petitioner is said to have fled away from the place of occurrence after seeing the police. The petitioner has got no criminal antecedent as stated in para 3 of the bail application.

Patna High Court CR. MISC. No.66744 of 2021(2) dt.01-04-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Having considered the fact that liquor has been recovered from the fodder house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
