The petitioner seeks regular bail in connection with Ariyari P.S. Case No. 60 of 2019 for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307 and 506 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner having assaulted the informant with lathi, khanti etc. and the informant is said to have sustained grievous injuries.

The learned counsel for the petitioner has submitted that the occurrence has been exaggerated in the FIR, which has taken place on account of a petty dispute in between the accused persons and the prosecution side, however, both the injuries have been found to be simple in nature. It is further

Patna High Court CR. MISC. No.52744 of 2019(3) dt.16-11-2019 2/2 submitted that the petitioner is having a clean antecedent and is languishing in custody since 06.06.2019. It is further submitted that the other accused persons, similarly situated, have already been granted the privilege of anticipatory bail vide order dated 27.09.2019 passed by a co-ordinate Bench of this Court in Cr. Misc. No. 41541 of 2019.

The learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheikhpura in connection with Ariyari P.S. Case No. 60 of 2019.
