JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2019 This application, for grant of anticipatory bail, arises out of Shankarpur P.S. Case No. 40/18, disclosing offences under Sections 341, 323, 380, 452, 427, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioners is that they along with others entered inside the house of the informant and committed loot of articles and also assaulted informant and others.

Submission of learned counsel for the petitioners is that they have falsely been made accused in the background of land dispute and earlier a proceeding under Section 144 Cr.P.C. was also initiated, which will appear from Annexure -3. Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Madhepura, in connection with Shankarpur P.S. Case No. 40/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
