This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 363, 366A, 120B and 504/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner has drawn my attention to the statement of the victim Sabitri Kumari, and contends that no offence as alleged against the petitioner is made out. He has further submitted that the informant gave a wrong and misleading information at the time of institution of the First Information Report that the age of the victim girl was 14 years whereas she herself has stated in her statement recorded under Section 164 Cr.P.C. that she was 19 years of age.

No.19743 of 2015 (3) dt.09-07-2015 2/2 In view of the submission as above, let the petitioners above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Kotwa P.S. Case No. 295 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
