JUSTICE BIRENDRA KUMAR ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-B)A, 26 and 35 of the Arms Act.

The police got information that co-accused, namely, Ghamandi Yadav is in possession of country made liquor and when his house was raided country made pistol and four cartridges were recovered. The petitioner was found fleeing from there. Submission is that the seizure list witnesses have stated on oath that the petitioner was not there and petitioner has got no criminal antecedent.

Considering the aforesaid facts, let petitioner, above named, in the event of his arrest or surrender before the Court

Patna High Court Cr.Misc. No.52577 of 2016 (2) dt.07-12-2016 below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/Successor Court in connection with Wazirganj (Tankuppa) Police Station Case No. 240 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
