The petitioners in these two cases seek pre-arrest bail in connection with Warisaliganj P.S. Case No. 258 of 2013 registered for the offences punishable under sections 420, 467,
Patna High Court Cr.Misc. No.17736 of 2015 (3) dt.08-09-2015 2/3 468, 471, 472, 473, 414 and 120-B read with 34 of the Indian Penal Code.
The prosecution case is that the police received information that innocent villagers are being cheated by certain people by running a contest through advertisement to recognize faces by their picture with an assurance to distribute prizes to the winners. During course of raid in the village, certain ATM Cards, Passbooks and mobile sets were recovered.
It is submitted by the learned counsel appearing for the respective petitioners that apart from suspicion raised against the petitioners, there is no other material to connect the petitioners with any offence as alleged in the FIR. It is further contended that similarly situated co-accused Manoj Singh has been granted anticipatory bail by a Bench of this Court vide order dated 20.03.2014 passed in Cr.Misc. No. 2493 of 2014, and relying upon the said order, another co-accused Guhan Singh @ Guhan has been granted anticipatory bail by a Bench of this Court vide order dated 13.04.2015 passed in Cr.Misc. No. 16898 of 2015. Learned counsel for the State does not dispute the submissions made by the learned counsels for the petitioners. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below
Patna High Court Cr.Misc. No.17736 of 2015 (3) dt.08-09-2015 3/3 within four weeks from today, petitioners of these two cases named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Warisaliganj P.S.
