JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This application, for grant of anticipatory bail, arises out of Khagaul P.S. Case No. 192 of 2018, disclosing offences under Sections 409, 467, 468, 471 of the Indian Penal Code. Allegation against the petitioner, who was working as cashier of the State Bank of India at the relevant time is that one Sarita Devi and Sapna Kumari deposited Rs. 35,000/- in the Bank and receipt was given but later on it was found that the amount was not deposited in the account.
Submission of learned counsel for the petitioner is that the receipt is annexed with the F.I.R., which does not show the signature of the petitioner rather it is of one Rabindra Rai, who was the then accountant in the Bank. Further, submission is that petitioner retired from the service more than ten years ago

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -V, Danapur, Patna, in connection with Khagaul P.S. Case No. 192 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
