The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the F.I.R., the allegation against petitioner is that he assaulted the informant with iron pipe on his left leg, due to which, his leg was broken.

It is submitted on behalf of petitioner that there is case and counter case and both sides sustained injury. Admittedly, there is land dispute between the parties. Petitioner has got clean antecedent.

However, learned counsel for the informant vehemently opposed the prayer for anticipatory bail and

Patna High Court CR. MISC. No.67698 of 2021(2) dt.18-07-2022 2/2 submitted that there is specific and direct allegation against this petitioner of assaulting the informant on his leg causing grievous injury.

Considering the specific allegation against this petitioner as well as nature of injury, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected.
