ANJANA MISHRA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of Opposite Party No.2 as well as the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Bhojpur Mahila P.S. Case No.271 of 2014 for allegedly having committed the offence under Sections 498A, 379/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Earlier notices were issued to O.P. No.2, who had appeared on 22.9.2015. However, on the said date, both the parties have been directed to be present in Chambers today at 4:00 P.M. so that the matter may be resolved amicably. Today, both the parties are present in person and they

Patna High Court Cr.Misc. No.18120 of 2015 (4) dt.01-10-2015 2/2 have agreed to resolve all the disputes and begin a new life in full harmony and peace. The petitioner is willing to take his wife Soni Devi and child Minakshi to her matrimonial home and will live peacefully.

Considering the present scenario and the bona fide act of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bhojpur at Ara, in connection with G.R. No.5760/14, arising out Bhojpur Mahila P.S. Case No.271 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

It is, however, made clear that if at all there is any untoward incident, it shall be open to O.P. No.2 to take appropriate legal recourse.
