Mr.Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in Barh P.S. Case No. 175 of 2021, registered for the offence punishable under Section 392 of the Indian Penal Code and section 25(1AB) of the Arms Act. As per the prosecution case, all the four named accused persons including this petitioner assaulted the informant and snatched his service revolver having four live bullets in the Magazine and fled away.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Nothing has been recovered from his conscious possession. Petitioner is in custody since 28.04.2021.

Learned APP however, vehemently opposed the prayer for bail and submitted that looted arms and ammunition

Patna High Court CR. MISC. No.66405 of 2021(2) dt.25-02-2022 2/2 have been recovered from house of this petitioner and is having criminal antecedent.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
