JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2022 Learned counsel for the petitioners at the outset seeks permission to withdraw the prayer for anticipatory bail with respect to petitioner no. 2, namely, Pintu Pandey @ Ravindra Pandey.

Permission is accorded.

Heard learned counsel for the petitioners, the informant and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks.

The petitioners apprehend their arrest in a case

Patna High Court CR. MISC. No.55455 of 2022(2) dt.15-11-2022 2/3 registered for the offences punishable under Sections 341, 323, 325, 307, 452, 354, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that rest of the petitioners are persons with clean antecedent and petitioner no. 3 is a young boy of 18 years of age.

The informant alleges that the accused persons including the petitioners came and outraged the modesty of the informant and her mother. Further, Ramendra Pandey assaulted her father by lathi causing fracture of his hand. It is alleged that Pintu Pandey assaulted her father by a Gandasa causing injury on his head.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. It is further submitted that as far as petitioner no. 3 is concerned, the allegation against him is general and omnibus in nature. It is next submitted that it was Pintu Pandey who assaulted causing grievous injury on the head of the father of the informant. It is also submitted that as far as allegation of assaulting the father of the informant causing fracture of hand by Ramendra Pandey is alleged, the same is not on the vital part of the body. Learned A.P.P. for the State and the informant opposed the prayer for anticipatory bail of the petitioners.

No.55455 of 2022(2) dt.15-11-2022 3/3 Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bhagwanpur (Belaon) P.S.
