2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 325, 307, 427, 384 of the Indian Penal Code and Section 27 of Arms Act.

3. As per prosecution case, the petitioner along with other co-accused persons assaulted the informant's side members due to which they sustained injures. The petitioner is alleged to have assaulted the father-in-law & brother-in-law of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is a dispute in respect of land between the parties due to which the

There is no specific overt-act against the petitioner rather general and omnibus allegation of assaulting leveled against him. It is further submitted that co-accused namely, Shital Yadav has already been granted bail by this Court vide order dt. 22.11.2022 passed in Cr. Misc. No. 27594 of 2022. The petitioner has got no criminal antecedent and languishing in judicial custody since 1.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Singheshwar P.S. Case No. 167 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura.
