Learned counsel for the State appears and submits that the petitioner questions the agreement entered in between the respondent No.6 and State. It is stated that the Water Resources Department had invited tender for two works i.e. tender for anti erosion work on the right bank of river Ganga near village Majharia from Ch.165 to 180 of B.K.G. for as well as for anti erosion work on the right bank of river Ganga near Hadipur Primary School in Chausa Block. It is submitted that pursuant to

Patna High Court CWJC No.1934 of 2012 (5) dt.16-02-2016 2/2 the tender, the private respondents and the petitioner responded thereto and finally the work was awarded to the respondent No.6. It is stated that the anti erosion work had to be completed by 15th May, 2012 and stands completed. The counter affidavit was served on learned counsel for the petitioner on 7.2.2013 but the statement has not been contested.

In the circumstances, no cause for indulgence is made out and the writ petition is accordingly disposed of. Bibhash/- (Jyoti Saran, J) U
