The petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that during vehicle checking Ranbir Kumar @ Arun Kumar Yadav was arrested with a stolen motorcycle who disclosed the name of the petitioner and two other accused as the member of the gang.

Learned counsel for the petitioner submits that the

No.66189 of 2021(2) dt.12-04-2022 2/2 name of this petitioner transpired in the confessional statement of co-accused Ranbir Kumar in police custody which has no evidentiary value. Learned counsel submits that thereafter the police raided the premises of the petitioner and it is alleged that a stolen motorcycle was found from his premises. Learned counsel submits that the petitioner was falsely implicated in the present cases and no recovery was made from his premises. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bhagwan Bazar P.S. Case No. 351 of 2021 with a condition that one of the bailors of the petitioner shall be his father Sunil Kumar. (Satyavrat Verma, J) Rishi/- U T
