Having regard to the nature of allegation for offence under sections 341, 323, 376 of the Indian Penal Code and sections 4, 6, 8, 10 of the Protection of Children from Sexual Offences Act (POCSO) this Court keeping in view the attending circumstances including the statement of the victim girl u/s 164 Cr.P.C. and the medical report is not inclined to grant privilege of anticipatory bail.
Thus, while rejecting the prayer for anticipatory bail of the petitioner it is hereby observed that if the petitioner surrenders and moves for regular bail, the same shall be decided on its own merit without being prejudiced by anything said in this order rejecting his prayer for anticipatory bail.
