2. The petitioner in the present case is seeking regular bail in connection with Begusarai Muffasil P.S. Case No.695 of 2023 registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code. He is in custody since 25.05.2024. The petitioner has got no criminal antecedent.

3. As per prosecution story, the informant alleged that 3-4 miscreants looted away his motorcycle and mobile when he was returning his home and assaulted him by pistol. It is further alleged that these miscreants also looted away one laptop from another vehicle (pickup van).

4. Learned counsel for the petitioner submits that the

No.60025 of 2024(2) dt.20-09-2024 2/3 the vehicle in question has been recovered from the house of coaccused Raj Kumar and the name of the petitioner has transpired in the confessional statement of the said co-accused Raj Kumar. Learned counsel submits that the said co-accused has been granted bail by a learned coordinate Bench of this Court in Cr.Misc.No.26650 of 2024. It is submitted that the petitioner has otherwise no criminal antecedent.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Having regard to the submission that the vehicle in question has been recovered from the house of co-accused Raj Kumar, the name of the petitioner has transpired in the confessional statement of the said co-accused and the said coaccused has been granted bail by a learned coordinate Bench of this Court in Cr.Misc.No.26650 of 2024 and the petitioner has otherwise no criminal antecedent, this Court directs release of the petitioner above named on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Begusarai Muffasil P.S. Case No.695 of 2023, subject to the conditions as laid down under Section 437(3) Cr.P.C.

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
