1. The State of Bihar .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Ashok Kumar, Adv. For the Opposite Party : Mr. Humayou Ahmad Khan, APP 155 ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-11-2016 Heard both sides.
The petitioner apprehends his arrest in Civil Lines P.S. Case No.67 of 2016 under Sections 175, 188, 477 and 420 of the Indian Penal Code.
Allegation against the petitioner is that the petitioner was Panchayat Sevak of Korma and Churi Panchayats falling within the jurisdiction of Nagar Block, Gaya, but, the petitioner in spite of direction did not submit the folders and registers with regard to appointment of teachers to the aforesaid Panchayats since the year 2003.
The learned counsel for the petitioner submits that the petitioner joined in the Panchayat in the month of July, 2011, in Churi and Korma Panchayats, but, on 01.02.2015 a theft was committed in the office of Panchayat Sevak of Chori and Korma and all the documents were stolen away, informatory petition was filed, but, it appears that the petitioner has destroyed the entire documents with regard to appointment of teachers of two Panchayats, namely, Korma and Churi and all the documents were found missing.
Considering the facts and circumstances, I am not inclined to enlarge the petitioner on anticipatory bail and the same is rejected.
