JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This is an application for grant of anticipatory bail in connection with Mirganj P.S. Case No. 196 of 2018, disclosing offences under Section 387 of the Indian Penal Code. Allegation as per F.I.R. is of extortion of rupees 5 lacs from the informant. Petitioner is not named in the F.I.R. Later on, he has been made accused in this case after confessional statement of co-accused Arif Raja.

Submission of learned counsel for the petitioner is that one co-accused person Shamsher, who has also named in the confessional statement by Arif Raja, has been granted privilege of anticipatory bail vide order dated 20.09.2018 passed in Cr. Misc. No. 57897 of 2018.

Having heard both sides, considering the above

Patna High Court Cr.Misc. No.77863 of 2018(2) dt.03-01-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 196 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is further subject to the condition that the petitioner will cooperate in the investigation of the case and will appear as and when required by the police, otherwise his bail bonds shall be cancelled.
