The petitioners apprehend their arrest in connection with Bochahan P.S. Case No.362 of 2019, registered for the offences punishable under Sections 147, 149, 283, 332, 333, 353 and 504 of the Indian Penal Code.

Due to death of a person in a road accident, the villagers blocked the traffic on National Highway. When the police came, allegation is that the crowd mishandled and obstructed in discharge of official duty by the police. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the

Patna High Court CR. MISC. No.55665 of 2022(2) dt.20-12-2022 2/2 present case. It is further submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is also submitted that similarly situated other coaccused persons have already been enlarged on anticipatory bail by different co-ordinate Benches of this Court. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Considering the fact that other co-accused persons have already been enlarged on anticipatory bail by different coordinate Benches of this Court, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Bochahan P.S. Case No.362 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
