JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in Supaul P.S. Case No. 322 of 2017 registered under Section 363, 366A/34 of the Indian Penal Code.

As per the prosecution case, the petitioner along with other accused persons are said to have kidnapped the minor daughter of the informant for performing marriage with his son, Shrawan Sah hatching conspiracy and uncle of the co-accused Shrawan Sah has given shelter to the victim and the Shrawan Sah. It is submitted by learned counsel for the petitioner that the petitioner happens to be father of the Shrawan Sah and merely being father has been falsely implicated in this case. No.54115 of 2017 (02) dt.13-12-2017 - 2 - filing a petition before the court has submitted that she happens to be major and she has performed marriage with Shrawan Sah out of her sweet will and has been living and enjoying marital life with him and her mother has filed false case against the accused persons. Similarly situated co-accused, namely, Hira Lal Sah has been enlarged on bail by a coordinate Bench of this court in Cr. Misc. No.43811 of 2017 vide order dated 21.09.2017. The petitioner has been languishing in custody since 13.06.2017. On the other hand, learned counsel for the informant has submitted that the petitioner being father of the Shrawan Kumar facilitated the kidnapping of the victim who is still traceless.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No.322 of 2017.
