The petitioner is apprehending his arrest in connection with S.T.Excise No.579 of 2018 arising out of Karjain P.S.Case nO.96/18 , registered for offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation as per FIR is of recovery of 24 ltrs. of liquor from one motorcycle and more than 1400 bottles of liquor from the Bolero vehicle and one person was arrested and name of the petitioner also transpired in the FIR.
Submission of the learned counsel for the petitioner is that FIR itself shows that nothing has been recovered from the possession of the petitioner and he has been named by the coaccused. He has no criminal antecedent.
Patna High Court Cr.Misc. No.78439 of 2018(2) dt.09-01-2019 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge-II-cum-Special Judge, Excise, Supaul in connection with S.T.Excise No.579 of 2018 arising out of Karjain P.S.Case No.96 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case.
With the aforesaid observation, this application is allowed.
