JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioners apprehend their arrest in relation to Bisfi P.S. Case No. 223 of 2013 registered under Sections 341, 323, 504, 506, 354, 835 and 379/34 of the Indian Penal Code and 3(i) of SC/ST Act.
Learned counsel for the petitioners submits that the whole allegation against the petitioners and others is of the huts and the house being burnt to ashes, but the same had been found false and the Police has submitted chargesheet only for wrongful restraint and assault, apart from SC/ST Act. Learned counsel submits that the true fact is that the informant and his family
Patna High Court Cr.Misc. No.18533 of 2015 (2) dt.11-06-2015 2/2 members want to forcibly occupy their land and have deliberately added offences attracting under Scheduled Castes and Scheduled Tribes Act so as to forcing arrest of the petitioners and others otherwise no offence is made out.
Be that as it may, in the event of their arrest/surrender before the court below within four weeks from today, let the petitioners, above named be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Bisfi P.S.
