Let the defect (s), as pointed out by the office, be removed within a period of four weeks from the date of resumption of physical filing and physical removal of defect. In the present case, the petitioner seeks bail in connection with Bidupur P.S. Case No. 172 of 2020 registered for the alleged offences under Sections 302 and 120(B) of the Indian Penal Code and section 27 of Arms Act.

It has been submitted at the outset by the learned senior counsel for the petitioner that bail petition of this petitioner has been rejected earlier vide order dated 10.03.2021 passed in Cr. Misc. No. 37024 of 2020. He very fairly concedes that except for passage of time, no new material has come up in support of the case of this

Patna High Court CR. MISC. No.66638 of 2021(3) dt.12-09-2022 2/2 petitioner. However, he submits that while disposing of this bail petition of co-accused Amrendra Singh, the learned trial court has been directed to expedite the trial and conclude the same within the period of nine months.

Learned APP for the State supports the contention regarding the rejection of bail in case of co-accused Amrendra Singh. Having regard to the facts and circumstances and similar nature of allegation against the petitioner as well as co-accused whose bail petition was earlier rejected vide order dated 10.08.2022 passed in Cr. Misc. No. 1214 of 2022 and further considering the fact that as there is no fresh ground since passing of the last order and learned trial court has already been directed to expedite the trial, the prayer for bail of this petitioner is rejected and the learned trial court is directed to strictly comply the order dated 10.08.2022 passed in Cr. Misc. No. 1214 of 2022.

However, if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail. (Arun Kumar Jha, J) Gautam/- U T
