JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 337 of 2016 registered for the offences punishable under Sections 448, 376, 511, 323, 324, 307, 504/34 of the Indian Penal Code.

Petitioner happens to be own brother in law of the informant who claims in her ferdbeyan that on the alleged date of occurrence, F.I.R. named accused, Gunjan Kumar Singh having entered into her house made an abortive attempt to rape her and at that time petitioner was standing outside the door and he was instigating the F.I.R. named accused to commit the crime. The informant has admitted in her ferdbeyan that there was land

Patna High Court Cr.Misc. No.44910 of 2016 (2) dt.08-12-2016 2/2 dispute between her as well as petitioner.

Submission on behalf of the petitioner is that the petitioner has been roped in this case on account of land dispute and moreover, the allegation of attempt to commit rape is against co-accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Lakhisarai in Lakhisarai P.S. Case No. 337 of 2016 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
