JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 This application, for grant of anticipatory bail, arises out of Patepur P.S. Case No. 165 of 2018, disclosing offences under Sections 302, 328/34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and allegation against him is of poisoning her causing her death. Submission of learned counsel for the petitioner is that there is no allegation of demand of dowry and torturing her and the materials collected during investigation also disclose that due to family feud, she committed suicide by consuming poison and she was taken to hospital for her treatment but she died.
Learned counsel for the State opposed the prayer for anticipatory bail on the ground that there is allegation against the petitioner of poisoning her.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -X, Vaishali, Hajipur, in connection with Patepur P.S. Case No. 165 of 2018, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
