Mr. SMT. ASHA KUMARI ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 16-01-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Sare P. S. case no. 46 of 2017 registered for the offences punishable under Section 365 of the Indian Penal Code. Informant is the uncle of the deceased and has filed written complaint on 25.03.2017 to the effect that his nephew Angad Kumar aged about four and half years was found missing from house and inspite of best efforts made by them he could not be traced. On the basis of written complaint FIR was registered and the matter was investigated by police. Subsequently, dead body of the victim boy was recovered from a well situated in an abandoned house of Bhola Singh. The name of petitioner has surfaced from the statement of accused

Patna High Court Cr.Misc. No.59525 of 2017(3) dt.16-01-2018 2/2 relative Bhola singh. It is further submitted that case of petitioner is on better footing than that of the co-accused Santosh Kumar who has been granted anticipatory bail by a Bench of this Court in Cr. Misc. no. 39651 of 2017. Petitioner has got clean antecedent and is in jail custody since 27.08.2017. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Biharsharif, Nalanda, in connection with Sare P. S. Case No. 46 of 2017.
