JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Barachatti (Mohanpur) P.S. Case No. 544 of 2015 registered under Sections325, 307, 302 & other minor sections of the Indian Penal Code.
Petitioners are ladies and no specific overt act has been attributed against them.
Submission on behalf of the petitioners is that some co-accused having similar allegation, have already been granted privilege of regular bail by different benches of this court. Considering the above-said facts and circumstances
Patna High Court Cr.Misc. No.42697 of 2016 (2) dt.22-11-2016 2/2 of the case as well as submission of the parties, particularly, keeping in mind that petitioners are ladies and no specific overt act appears to have been attributed against them, this anticipatory bail petition is allowed and it is ordered that the petitioners named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Barachatti (Mohanpur) P.S. Case No. 544 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
