The petitioner seeks bail in connection with Rosera P.S. Case no. 272 of 2016 registered for the offence punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code. The petitioner is said to have assaulted the informant and her two sons Deepak Kumar and Pankaj Kumar by means of sword over land dispute.
It is submitted by the learned counsel for the petitioner that there is a land dispute between the parties. There is case and counter case between the parties. Petitioner happens to be brother of the husband of informant. Though, doctor has found sharp cut injury on the person of the informant (Punam
Patna High Court Cr.Misc. No.54027 of 2017 (2) dt.14-11-2017 2/2 Devi) and her son Pankaj Kumar on 26.10.2016, but the opinion regarding nature of injury has not been given by the doctor for want of supplementary injury report even after lapse of around one year. The petitioner has been languishing in custody since 25.07.2017.
Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Rosera, District-Samastipur in connection with Rosera P.S. Case no. 272 of 2016.
