JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 This application, for grant of anticipatory bail, arises out of Dhanarua P.S. Case No. 34 of 2019, disclosing offences under Sections 363, 365/34 of the Indian Penal Code. Allegation against the petitioners and others is of kidnapping of son of the informant.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and son of the informant himself returned and further there is delay of 34 days in lodging F.I.R. and prior to filing of this case, petitioners have lodged a case against the informant and in retaliation, this false case has been lodged.

Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Masaurhi, Patna. in connection with Dhanarua P.S. Case No. 34 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
