The petitioner apprehends her arrest in Sanjhauli P.S. Case No.50 of 2019 registered under Section 379 of the Indian Penal Code and under section 135 of the Electricity Act. The electric connection of the petitioner was disconnected on account of default of payment of Rs.66,391/-. The petitioner was found running flour mill and consuming electric energy. The department assessed loss to tune of Rs.3,42,873/-.

Learned counsel for the petitioner submits that the amount of loss is exaggerated but the petitioner is ready to deposit Rs.1,50,000/- within 45 days from today. On such,

Patna High Court CR. MISC. No.52420 of 2019(2) dt.22-08-2019 2/2 learned counsel appearing on behalf of the South Bihar Power Distribution Company Limited submits that the petitioner may appear before the authority and settle the dispute and pay the remaining amount within reasonable time.

Having considered the facts and the undertaking that the petitioner is ready to deposit Rs.1,50,000/- within 45 days, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj (Rohtas) in connection with Sanjhauli P.S. Case No.50 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, with further condition that if the petitioner fails to deposit Rs.1,50,000/- within 45 days from today, the learned court below shall cancel the bail bond of the petitioner forthwith after lapse of 45 days from today.
