Case diary of this case had been called for earlier which has been received.
The petitioner is apprehending his arrest in Bhabua P.S. Case no.316 of 2014 for the offences under Sections 448, 380, 366(A), 376, 361 and 372 of the Indian Penal Code. Learned counsel for the petitioner submits that the present case has arisen out of a love affair existing between the petitioner and the complainant who had returned to her house. It is further submitted that there is an inordinate delay in filing F.I.R. and also in a complaint petition. It is further submitted that the girl in question who is major had eloped herself with a view to marry
Patna High Court Cr.Misc. No.20251 of 2015 (3) dt.29-09-2015 2/2 to the petitioner and on coming back since the petitioner's marriage was solemnized elsewhere present case has been lodged against the petitioner.
Considering the facts and circumstance of the case and materials which has surfaced on the case diary, let the petitioner, in the event of his arrest or surrender before the court below within three weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Kaimur at Bhabua, in Bhabua P.S. Case No.316 of 2014 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
