Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A, 376, 212 of the Indian Penal Code and Section 4 of the POCSO Act. The FIR was lodged with allegation of kidnapping of the minor daughter of the informant. The statement of the victim-girl recorded under Section 164 Cr.P.C. would reveal that the matter is of love affair and consensual physical relation. The petitioner is in custody since 07.01.2017.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.58503 of 2017 (2) dt.14-12-2017 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Bahadurpur Police Station Case No. 451 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
