JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 120(B), 420, 489(A), 489(B), 489(C) of the Indian Penal Code.

As per the prosecution case, on 16.06.2021 upon secret information a raid was conducted in the house of Dharmendra Singh Yadav @ Dhanji Yadav and huge quantity of counterfeit notes of various denomination, printer, 10 ATM cards, 2 PAN cards, Punching machine, mobile phones and plain paper, which is used in printing notes, were recovered. This petitioner along with three other accused persons were apprehended on the spot.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the

No counterfeit note has been recovered from the conscious possession of the petitioner and he is implicated in this case only on suspicion. The recovery is made from the house of coaccused, Dharmendra Singh Yadav @ Dhanji Yadav. Petitioner claims clean antecedent and is in custody since 17.06.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Buxar in connection with Rajpur PS case No.118/2021.
