JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-02-2018 Cr. Rev. No. 381/2015:- The petitioner is aggrieved by the judgment and order dated 12.02.2015 passed in Cr. Appeal No. 125/2012 by the learned Additional Sessions Judge III, Patna, whereby the judgment and order of acquittal dated 17.07.2012 passed by the learned S.D.J.M., Patna in connection with Kadamkuan P.S. Case No. 139/2006 instituted for the offences under Section 498A/34 of the Indian Penal Code, Sections 3 and 4 of the Dowry Prohibition Act, 1961 and Sections 4 and 5 of the Prevention of Witch (Daain) Practices Act,

Patna High Court CR. REV. No.381 of 2015 (3) dt.09-02-2018 2/2 1999, acquitting the opposite parties, has been affirmed and upheld. On going through the judgments rendered by the trial court as well as the appellate court, this Court finds no reason to interfere with the aforesaid judgment and order of acquittal passed by both the courts.

The present revision petition is dismissed.

Cr. Rev. No. 407/2015:- The opposite party no. 2 had been convicted by the trial court, viz. S.D.J.M., Patna in connection with Kadamkuan P.S. Case No. 139/2006 instituted for the offences under Section 498A of the Indian Penal Code, Sections 3 and 4 of the Dowry Prohibition Act and Sections 4 and 5 of the Prevention of Witch (Daain) Practices Act, 1999; which judgment and order of conviction has been set aside by the judgment dated 12.02.2015 passed in Cr. Appeal No. 112/2012 by the learned Additional Sessions Judge III, Patna and opposite party no. 2 has been acquitted of all the charges. Issue notice to the opposite party no. 2 through ordinary process as well as under registered cover with A/D, on steps being taken by the petitioner, within a period of three weeks from today, returnable on 02.04.2018.
