The Petitioner seeks bail in Karjain P.S. Case No. 77 of 2016 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 332, 333, 307, 353, 436, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of causing injury by sharp cutting weapon upon the head of Noor Hasan in which he has sustained injury.

It has been submitted that for the same incident Karjain P.S. Case No. 78 of 2016 was instituted by Md. Jakir brother of the injured in which co-accused Md. Hasmuddin who is also accused in this case, had been granted bail by a coordinate bench of this Court vide order dated 07.12.2017 in

Patna High Court Cr.Misc. No.59139 of 2017(2) dt.12-01-2018 2/2 Criminal Miscellaneous No. 55429 of 2017. The petitioner is in custody since, 18.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Birpur (Supaul) in connection with Karjain P.S. Case No. 77 of 2016.
