JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 504, 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code has been added.

Allegation against the petitioner and two others is that they assaulted the son of the informant, as a result whereof, he died after three months during course of treatment. Similarly situated co-accused, namely, Chunu Das @ Satish Kumar Das has already been allowed bail by a Coordinate Bench of this Court in Cr.Misc.No. 53119/2017 on 15.11.2017.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.61455 of 2017 (2) dt.19-12-2017 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pandaul P.S.Case No. 78 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
