The petitioners seek pre-arrest bail in connection with Alauli P.S.Case No. 152 of 2017 registered under Sections 341, 323, 324, 325, 307, 427, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted by the learned counsel for the petitioners that the specific allegation of assault in the First Information Report is against co-accused Ganesh Singh, Rajesh Singh and Ritesh Singh. So far as the petitioners are concerned, there is no allegation that they assaulted the informant or any other member of the prosecution party. He submitted that there is admitted land dispute between the parties and due to that names of
Patna High Court Cr.Misc. No.61052 of 2017 (2) dt.22-12-2017 2/2 the petitioners have also been given in the First Information Report.
Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioners. He submitted that there is allegation against all the petitioners that they participated in the commission of the offence. Having regard to the nature of allegation, in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S.Case No. 152 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
