JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Ghorasahan PS Case No. 335 of 2017 registered under Sections 302, 120B/34 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that the named co-accused persons along with four-five unknown killed son of the informant. Learned Counsel for the petitioner submits that there is no material against the petitioner except regarding his presence as stated by the co-accused in his confessional statement, whereas there is specific allegation of assault and killing the deceased against named accused persons in the FIR itself. The petitioner has clean antecedent, he has been implicated in this case only for being relative of one of the accused.
Having considered the said facts and circumstances, the petitioner, namely, Gopal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Sikrahana at Motihari in connection with Ghorasahan PS Case No. 335 of 2017.
