Petitioner, already in custody, seeks bail in connection with Bihariganj P.S. Case No.70 of 2017, registered under Sections 447, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

Allegation in brief is that due to land dispute the accused persons assaulted the informant and others and this petitioner is alleged to have given a garasa blow over the head of Khalil Ansari causing grievous injury.

Learned counsel for the petitioner submits that there is case and counter case and due to land dispute the petitioner has falsely been implicated, the opinion given by the doctor is on the

Patna High Court Cr.Misc. No.61254 of 2017 (2) dt.20-12-2017 2 /2 basis of the C.T. Scan report of a private clinic. Having considered the specific allegation against the petitioner causing grievous injury on head and fracture, prayer of bail of the petitioner is refused at present in connection with Bihariganj P.S. Case No.70 of 2017, pending in the court of learned Judicial Magistrate, 1st Class, Udakishunganj, District Madhepura.

However, the petitioner may renew his prayer for bail after six months.
