The petitioner apprehends his arrest in Complaint case (G.O.) No. 44 of 2016 for the offences punishable under Section 18 (C) 26 (b) (ii) 18 (a) (vi) 27 (d) 18 (A), 28 of Drugs and Cosmetics Act and under Section 420 of the Indian Penal Code. The Drug Inspector raided the godown of M/s Capital Drug Agency, Moolchand lane and alleged that petitioner had kept the drugs without having any valid license of the godown.
The learned counsel for the petitioner submits that petitioner has got valid license vide License No. 60A/2005. After raid the license of the petitioner was cancelled but the petitioner
Patna High Court Cr.Misc. No.209 of 2018 (2) dt.16-01-2018 2/2 filed and appeal under the Act. The petitioner also move before this court vide CWJC No. 9258 of 2016 and the same was disposed of 14.07.2016 with a direction to the appellate authority to dispose of the appeal of the petitioner.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Complaint case (G.O.) No.44 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
