2. The petitioners have preferred this application for grant of regular bail in connection with Belaganj P.S. Case No. 259/2025 dated 10.05.2025 registered for the offence punishable u/s 126(2), 115(2), 109(1), 352, 303(2), 351(2) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, when the informant was in his field he saw that the cattles of the petitioner no. 1 was destroying the onion crop of the informant. On objection, the petitioner no. 1 started abusing and assaulting the informant. On 09.05.2025, the informant went to see his onion crop, the
Patna High Court CR. MISC. No.57101 of 2025(2) dt.25-08-2025 2/3 petitioners and the co-accused person holding lathi-danda and iron rod assaulted him with an intent to kill. The co-accused, Chandra Bhushan Singh and the petitioner no. 2 assaulted him with an iron rod causing head injury due to which he fell on the ground and they continued to assault the informant. Thereafter, villagers came there and the informant was taken to hospital for treatment. They also threatened the informant that they would kill him and his family members if he would lodge any case. The informant has further alleged that they also snatched gold chain from him.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case on account of land dispute. There is general and omnibus allegation against the petitioners. As per the impugned order, the injury is simple in nature but the injury is caused on the vital part of the body. The petitioners have one antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 29.05.2025
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners
Patna High Court CR. MISC. No.57101 of 2025(2) dt.25-08-2025 3/3 above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya, in connection with Belaganj P.S. Case No. 259/2025, with the condition:- (i). The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
7. The application stands allowed.
