JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 337, 307/34 and 380 of the Indian Penal Code. Referring to the First Information Report, learned counsel appearing on behalf of the petitioners submits that the informant and the petitioners are neighbors. Allegedly, on the date of occurrence, the petitioners and others attacked the house of the informant with stones etc. due to which the informant sustained injuries. Learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.19281 of 2015 (2) dt.25-06-2015 2/2 no offence under Section 307 of the Indian Penal Code is made out against these petitioners on the basis of the allegation, as contained in the First Information Report. He further also submits that there are series of litigations between the petitioners' side and the informant's side. In view of the submission as above, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 60 of 2015 (G.R. No. 923 of 2015), subject to condition laid down under Section 438
(2) of the Code of Criminal Procedure.
