The petitioners apprehend their arrest in Ghosi P.S. Case No. 21 of 2021, registered for the offences punishable under Sections 406, 409 and 34 of the Indian Penal Code. As per the FIR, these petitioners defalcated government money of Rs. 14,19,700/- which was sanctioned for the Har Ghar Nal Ka Jal Yojana and not completed the work for the which the money was sanctioned. Petitioner no. 1 is Secretary of Ward Execution and Management Committee and petitioner no. 2 is Chairman.

It is submitted on behalf of petitioners that the alleged work has already been completed as per the standard under the

Patna High Court CR. MISC. No.66247 of 2021(2) dt.24-05-2022 2/2 guidance of senior officials. Petitioners have been falsely implicated due to village politics. Petitioners have got clean antecedents.

Counsel for the State opposed the prayer for bail and submitted that these petitioners are responsible for the execution of the work in question and after withdrawing the huge government money they have not completed the work. Considering the facts aforesaid and nature of allegation, I am not inclined to enlarge the petitioners abovenamed on anticipatory bail. Accordingly, the same is rejected.
