JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 28-09-2016 Heard the counsel for the petitioner and the State. The petitioner apprehending his arrest in Warsaliganj P.S. Case No. 18 of 2016 registered under Sections 302/201/34 of the Indian Penal Code as well as 3(i)(x) of SC/ST (Prevention of Atrocities) Act has filed the present application The allegation against the petitioner is that earlier, he had threatened the informant with dire consequences. In the name of holding Panchayati, the petitioner persuaded the husband of the informant to go along with him. The husband did not return. The following day in the morning, the dead body of the informant's husband was found deserted in the nearby field. Contention of the petitioner is that no independent witness has supported the allegation that the petitioner had
Patna High Court Cr.Misc. No.36145 of 2016 (2) dt.28-09-2016 2/2 persuaded the deceased and took him along. There is animosity prevailing with them.
Learned APP opposed the prayer and submits that the petitioner was last seen with the deceased. There is a strong motive against him also.
Considering the seriousness of the allegation and the other materials reflected from the records, I am not persuaded him to extend the privilege of anticipatory bail. The prayer is rejected.
